Groubert was fired shortly after the September 4 shooting which occurred during a stop for a suspected seat belt violation. The video was released at his bond hearing and bond was set at $75,000. Groubert's attorney says the shooting was justified because the officer feared for his life. Would that excuse have worked for the victim?

As weak as the argument might be,the subjective sense of danger ("I feel threatened") has been used successfully in a multitude of venues. This tactic has been highly effective at squelching free speech on college campuses.
